Agreement to Terms
By accessing or using the services provided by MFY Menifee Masonry, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our services or website. These terms apply to all visitors, customers, and others who access or use our masonry services.
Services Provided
MFY Menifee Masonry provides professional masonry services including but not limited to brick repair, chimney services, tuckpointing, retaining walls, patios, stone veneer installation, and other related masonry work. All services are subject to availability, proper permits, and compliance with local building codes. We reserve the right to refuse service if safety concerns, permit issues, or other legitimate reasons make a project unfeasible.
Estimates and Pricing
We provide free on-site estimates for masonry projects. All estimates are valid for 30 days from the date provided unless otherwise specified. Pricing is based on the scope of work assessed during the estimate. If unexpected conditions are discovered during the project such as hidden damage, structural issues, or code violations, we will notify you immediately and provide a revised estimate for any additional work required. Final pricing may differ from the initial estimate only when such unforeseen circumstances arise, and you will always have the option to approve or decline additional work.
Payment Terms
Payment terms will be specified in your project contract or estimate. Typically, we require a deposit before work begins, with the balance due upon completion. We accept cash, checks, and major credit cards. For larger projects, we may arrange a payment schedule with milestone-based payments. All payments are due within the timeframe specified in your contract. Late payments may be subject to interest charges as permitted by California law.
Project Timeline and Delays
We strive to complete all projects within the estimated timeframe. However, completion dates may be affected by weather conditions, permit delays, material availability, or unforeseen site conditions. We will communicate any delays promptly and work diligently to minimize disruptions. You agree that reasonable delays beyond our control do not constitute a breach of contract.
Warranty and Guarantees
We stand behind our workmanship and provide warranties on labor as specified in your project contract. Material warranties are provided by the manufacturers and will be passed through to you. Our warranty covers defects in workmanship under normal use and does not cover damage from accidents, improper maintenance, natural disasters, or modifications made by others. To maintain warranty coverage, you must follow any maintenance recommendations we provide.
Property Access and Site Conditions
You agree to provide clear access to the work area and ensure that pets are secured during our work hours. We will take reasonable care to protect your property but are not responsible for damage to landscaping, underground utilities not properly marked, or existing structures affected by necessary work. You are responsible for removing any valuable items, outdoor furniture, or decorations from the work area before we begin. If access issues prevent us from completing work on scheduled days, additional trip charges may apply.
Permits and Compliance
When required, we will obtain necessary building permits for your project. Permit fees are typically separate from our labor and materials charges. You are responsible for ensuring that any existing structures comply with local codes before we begin work. If your project requires approval from a homeowners association, you must obtain that approval before work commences. We comply with all applicable California contractor licensing laws and local building codes.
Cancellations and Changes
You may cancel a project before work begins, subject to cancellation fees for materials already ordered or other costs incurred in preparation. Once work has started, cancellation may result in charges for completed work and materials. Changes to the project scope must be requested in writing and may affect pricing and timeline. We will provide a change order for your approval before proceeding with any modifications to the original contract.
Limitation of Liability
Our liability for any claims related to our services is limited to the amount you paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages. This limitation applies to the fullest extent permitted by California law. We maintain appropriate insurance coverage as required by law, and serious claims may be submitted to our insurance carrier.
Dispute Resolution
We are committed to resolving any concerns promptly and fairly. If you have a dispute regarding our services, please contact us directly so we can work toward a resolution. If we cannot resolve the matter through direct communication, you agree to participate in mediation before pursuing legal action. Any legal disputes will be governed by California law and resolved in the courts of Riverside County.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. For active projects, the terms in effect at the time of contract signing will govern that specific project.
